Purpose of Consent

NUA Pilates Studio provides the Guest with the opportunity, based on their voluntary consent, to receive information about the Studio’s:

of its services;
of its Reformer Pilates classes and new class types;
of its new services;
of its workshops and other events;
of its promotions and discounts;
of its pass and package offers;
of its seasonal or individual offers;
of its prize draws;
of news and updates concerning the operation of NUA Pilates Studio;
of its other marketing and promotional content.

The Data Controller shall send marketing communications exclusively through the communication channel for which the data subject has provided the appropriate consent.

E-mail Newsletter and Marketing Communications (to be marked with an X)

I consent to Barta Reform Kft. sending a newsletter and electronic messages for direct marketing purposes to the e-mail address I have provided regarding the services, programmes, events, news, discounts, promotions and offers of NUA Pilates Studio.

The data processed for e-mail marketing communications:

name;
email address
the fact that consent was given;
the date and time of consent;
the fact and date of withdrawal of consent.
the technical data necessary to demonstrate that consent was given, where consent is provided electronically.

Marketing Communications via SMS (to be marked with an X)

I consent to Barta Reform Kft. sending me marketing SMS messages to the phone number I have provided regarding the services, programmes, events, discounts, promotions and offers of NUA Pilates Studio.

The data processed for SMS marketing purposes:

name;
phone number;
the date and time of consent;
the fact and date of withdrawal of consent.

Telephone Direct Marketing (to be marked with an X)

I consent to Barta Reform Kft. contacting me by telephone at the phone number provided regarding the services, programmes, discounts or offers of NUA Pilates Studio for the purpose of direct marketing.

The data processed for telephone marketing purposes:

name;
phone number;
the date and time of consent;
the fact and date of withdrawal of consent.

Voluntariness of Consent

I acknowledge that the consent given for marketing and newsletter communications is entirely voluntary.

Giving consent is not a condition for:

the use of NUA Pilates Studio’s services;
registration;
appointment booking;
the purchase of a ticket or pass;
participation in Reformer Pilates classes.

The Guest shall not suffer any disadvantage as a result of refusing or subsequently withdrawing their consent.

Distinction Between Service Messages and Marketing Messages

I acknowledge that this declaration applies exclusively to marketing and direct marketing communications.

NUA Pilates Studio may also send messages necessary for the provision of its services without marketing consent, where such messages are necessary for the performance of the contract or for another lawful purpose.

Such messages may include, in particular:

booking confirmation;
appointment reminder;
modification or cancellation of a booked class;
waitlist notifications;
payment-related information;
information regarding the validity or use of the Guest’s pass;
information regarding any changes to the Studio’s operations that affect an already booked service;
safety information or other information necessary for the use of the services.

In the absence of marketing consent, the Data Controller shall not include direct marketing content in such messages.

Legal Basis for Data Processing

The legal basis for processing personal data for marketing and newsletter purposes is the data subject’s voluntary consent, pursuant to Article 6(1)(a) of the GDPR.

For electronic advertising or direct marketing communications, the Data Controller shall also comply with the applicable laws and regulations governing electronic commerce and advertising.

Duration of Consent

Consent shall remain valid until withdrawn.

The Data Controller shall process the personal data necessary for marketing communications until consent is withdrawn, except for data that must be retained for a limited additional period where necessary to demonstrate that consent was given or withdrawn, or to establish, exercise or defend legal claims.

Withdrawal of Consent and Unsubscribe

I acknowledge that I may withdraw my marketing consent at any time, without giving a reason and free of charge.

The withdrawal of consent may be carried out, in particular, in the following ways:

In the case of an e-mail newsletter:

by using the unsubscribe option provided in individual marketing e-mails; or
by submitting a request to the Data Controller at [●] e-mail address.

In the case of SMS or telephone marketing:

by submitting a request to the Data Controller at [●] e-mail address.
via the Studio’s [●] telephone number; or
by any other unsubscribe method provided by the Data Controller.

The withdrawal of consent must be as easy to exercise as giving consent.

The withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal.

Withdrawal of Consent by Communication Channel

I acknowledge that I may withdraw my consent for each individual marketing channel independently.

For example, I may request:

the discontinuation of e-mail newsletters only;
the discontinuation of SMS marketing only;
the discontinuation of telephone marketing communications only; or
the discontinuation of all marketing communications.

The withdrawal of consent for one communication channel shall not, in itself, affect any separate consent given for another communication channel.

Proof of Consent

The Data Controller is entitled to process the data necessary to demonstrate that consent has been given.

In the case of electronic consent, such data may include, in particular:

the date and time of consent;
the version of the declaration accepted at the time of consent;
the selected communication channel;
the technical log data evidencing that consent was given;
where necessary, the fact and date of confirmation of the e-mail address.

The Data Controller may also document the withdrawal of consent to ensure that the data subject does not subsequently receive marketing communications to which they have withdrawn their consent.

Newsletter and Other Service Providers

The Data Controller may engage data processors, such as newsletter, SMS or IT service providers, for the technical implementation of marketing communications.

Detailed information about the data processors engaged, any transfers of personal data outside the European Economic Area, and the safeguards applicable to such transfers is provided in the NUA Pilates Studio’s current Privacy Policy.

Newsletter Statistics and Tracking

Where the newsletter service provider used by the Studio allows for the measurement of whether the recipient:

whether they have opened the e-mail;
whether they have clicked on any link;
when the opening or click occurred;

The conditions and legal basis for such data processing shall be separately specified in the NUA Pilates Studio Privacy Policy, taking into account the technology used.

The Studio shall only use such tracking in compliance with the applicable data protection and electronic communications requirements.

Profiling

By giving marketing consent, the NUA Pilates Studio does not automatically obtain the right to use the Guest’s health data, health-related information concerning their exercise, or the contents of their health declaration for marketing profiling purposes.

The use of health data for marketing purposes is not permitted.

If, in the future, the Studio intends to use the Guest’s purchase, booking or enquiry data to create a personalised marketing profile, the Guest will be informed separately in advance about the relevant conditions and, where required, separate consent will be obtained.

I declare that, prior to giving this consent, I had the opportunity to review the NUA Pilates Studio Privacy Policy, which provides detailed information in particular regarding:

the identity and contact details of the Data Controller;
the purpose and legal basis of the data processing;
the duration of the data processing;
the data processors;
any potential transfers of personal data to third countries;
the rights of the data subject;
the withdrawal of consent;
the available legal remedies.
