GENERAL TERMS AND CONDITIONS

1. General Provisions

1.1. Purpose and Scope of the General Terms and Conditions

These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the terms and conditions for the use of services provided by the reformer Pilates studio operated by Barta Reform Szolgáltató Korlátolt Felelősségű Társaság under the name NUA Pilates Studio.

These GTC apply to all services provided by NUA Pilates Studio, whether used in person or electronically, as well as to individual sessions, passes, packages, gift vouchers and other services offered for sale by the Studio.

By ordering a service, booking an appointment, or purchasing a ticket or pass, a contractual relationship is established between the Guest and the Service Provider, which shall be governed by the provisions of these GTC.

Hereinafter referred to as the “Service Provider” or the “Studio”.

1.3. The Guest

A Guest shall mean any natural person who uses the services of the Studio, books an appointment, purchases a ticket, pass or other service, or enters the premises of the Studio for the purpose of using its services (hereinafter referred to as the “Guest”).

By using the services, the Guest declares that they have read, understood and agree to be bound by these GTC and the current House Rules of NUA Pilates Studio.

2. Services Provided by NUA Pilates Studio

2.1. The Service Provider primarily offers Reformer Pilates classes, as well as related exercise and recreational services.

The services may be used in particular in the following forms:

a) group Reformer Pilates classes;
b) private Reformer Pilates classes;
c) duo or small-group classes;
d) beginner/introduction classes;
e) themed or specialised classes;
f) workshops, events or other programmes announced in advance.

The services currently available, their duration, fees and any specific terms and conditions are set out in the Studio’s current price list, online booking system and other information provided by the Studio.

2.2. The Pilates service does not constitute a healthcare service, and any instructions provided by the instructor shall not be considered medical diagnosis, medical treatment, physiotherapy or any other form of healthcare advice.

The Studio and the instructor are not qualified to medically assess the Guest’s fitness to participate. If the Guest is uncertain whether their health condition allows them to take part in the exercise, they must seek the advice of an appropriate healthcare professional before participating.

3. Registration and Booking

3.1. The Studio’s services may be used by prior booking, unless otherwise specified by the Service Provider.

Bookings may be made:

a) through the online booking system used by the Studio;
b) via the Studio’s website;
c) in person; or
d) by any other method specified by the Service Provider.

3.2. The Guest is required to provide true, accurate and their own personal information during registration and booking.

The Guest is responsible for ensuring that the contact details provided are accurate and suitable for receiving notifications from the Service Provider.

3.3. The Guest must keep the login credentials associated with their user account confidential.

The Guest is entitled to book an appointment in their own name and for their own use, unless the booking system or the Service Provider expressly permits bookings to be made on behalf of another person.

4. Conclusion of the Contract

4.1. The contract between the Guest and the Service Provider is concluded upon successful booking of the relevant service or, where the service requires advance payment, upon successful completion of the payment.

4.2. In the case of an online booking, the booking shall be considered successful once it has been confirmed by the booking system or the Service Provider.

4.3. By finalising the booking, the Guest declares that:

a) they have familiarised themselves with the essential characteristics of the service;
b) they have reviewed the service fee and the applicable payment terms;
c) they have read and accept these GTC and the House Rules;
d) they meet the requirements for using the service.

5. Fees, Payment and Invoicing

5.1. The current fees for the services are set out in the Studio’s current price list and/or online booking system.

The Service Provider reserves the right to modify the fees for its services with effect for the future. Unless otherwise provided on terms more favourable to the Guest, such modifications shall not affect the use or validity of passes that have already been purchased and remain valid.

5.2. Payment may be made using the payment methods provided by the Studio, including in particular by credit or debit card, online card payment, bank transfer or, where made available by the Studio, on-site payment.

5.3. The Service Provider shall issue a receipt or invoice for the payment in accordance with the applicable laws and regulations.

6. Tickets, Passes and Packages

6.1. The Guest may use the services by purchasing a single session, pass or package as specified in the Studio’s current price list.

6.2. Unless expressly stated otherwise, a pass is personal and non-transferable, may not be used by another person and cannot be redeemed for cash.

6.3. The pass shall be valid from the date and for the period specified at the time of purchase or in the terms and conditions applicable to the relevant type of pass.

The Guest is responsible for booking and using all sessions within the validity period of the pass.

Any unused sessions shall expire at the end of the validity period, unless otherwise required by applicable law or the Service Provider makes an individual discretionary exception.

6.4. The validity period of a pass may only be extended in accordance with the conditions specified in advance by the Service Provider or, on an individual basis, in the event of documented and justifiable circumstances.

The Guest is not automatically entitled to an extension of the validity period of the pass.

7. Rescheduling and Cancellation

7.1. A booked session may be cancelled free of charge up to [24] hours before the scheduled start time or, subject to availability, rescheduled.

7.2. If the booking is properly cancelled within the above cancellation period, the session will not be deducted from the Guest’s pass. In the case of a single-session purchase, the session may be used at another time in accordance with the Studio’s applicable terms and conditions.

7.3. Late Cancellation

If a cancellation is made after the cancellation deadline, the booked session shall be considered used and the fee paid for the session shall not be refunded.

If a booked class is cancelled within 24 hours of the scheduled start time, 50% of the session fee will be charged.

If a pass is used and the session is cancelled within 24 hours of the scheduled start time, 50% of the value of the session will be deducted from the pass.

7.4. No Show 

If a guest fails to attend a booked class without prior cancellation, the session will be considered used.

7.5. In exceptional and duly documented circumstances, the Service Provider may deviate from the provisions of this section in favour of the Guest. Any such individual discretionary exception shall not create an entitlement to similar treatment in future cases.

8. Late Arrival

8.1. The Guest must arrive in sufficient time to be changed and ready to begin the workout by the scheduled start time of the class.

For a first visit, it is recommended to arrive at least 10–15 minutes before the scheduled start time.

8.2. For the safe use of the Reformer equipment, proper warm-up, and the smooth running of the class, the instructor reserves the right to refuse participation to a Guest who arrives late if it is no longer possible for them to join the class safely.

In such cases, if the delay is attributable to the Guest, the session shall be considered used.

9. Cancellation and Modification of Classes by the Studio

9.1. The Service Provider reserves the right, where justified, to change the scheduled time of a class, the instructor, or any other circumstances that do not affect the essential nature of the service.

9.2. If the Service Provider cancels a class, the Guest shall not lose the session.

The affected session will be credited back to the Guest’s pass. In the case of a single-session purchase, the Guest may choose to use it for another available time or, if the service is not provided, the Service Provider shall refund or otherwise settle the amount paid for the session.

10. Participation and Health Requirements

10.1. Reformer Pilates is a form of physical exercise involving physical activity. Even when performed correctly and under proper instruction, participation may involve physical exertion, muscle fatigue, muscle soreness, loss of balance, or injuries associated with sports and physical activity.

10.2. The Guest may only use the services if they are in a state of health that allows them to safely participate in the chosen form of exercise.

10.3. The Guest must inform the instructor, before the start of the class, of any known condition or circumstance that may affect the safe performance of the exercises.

Such circumstances may include, in particular, an injury, recent surgery, a musculoskeletal condition, pregnancy, or any other condition that may be relevant in relation to physical exertion.

10.4. In case of doubt, the Guest must seek the advice of a physician or other appropriate healthcare professional before using the services.

10.5. The Guest must immediately inform the instructor of any pain, dizziness, illness, difficulty breathing, or other unusual symptoms experienced during the workout and must stop performing the exercise.

10.6. The instructor reserves the right to refuse the Guest’s participation or discontinue the workout if, in their judgement, the Guest’s condition, behaviour, or the information available to them indicates that continuing the workout may pose a risk to the safety of the Guest or any other person.

This does not constitute a medical opinion regarding the Guest’s health condition.

11. Use of Reformer Equipment and Other Equipment

11.1. The Reformer machines and other exercise equipment in the Studio may only be used for their intended purpose and in accordance with the instructor’s instructions.

11.2. In particular, the Guest is not permitted, without the instructor’s prior permission, to:

a) use the Reformer machine;
b) change its spring resistance or settings;
c) remove or reposition any safety equipment or components;
d) perform any exercise that has not been instructed by the instructor;
e) change the settings of another Guest’s machine.

11.3. The Guest must comply with the instructor’s safety and professional instructions.

The instructor reserves the right to prohibit, modify or stop any exercise if they consider it necessary for safety reasons.

12. Liability Provisions

12.1. The Service Provider shall provide the services with the level of professional care generally expected under the circumstances, ensure safe conditions, and maintain the equipment provided by the Service Provider in a condition suitable for its intended use.

12.2. The Guest must comply with the GTC, the House Rules, the rules governing the use of the equipment, and the instructor’s instructions in order to ensure their own safety.

12.3. The Guest shall be liable for any damage resulting from intentional or otherwise culpable conduct on their part, failure to follow the instructor’s instructions, improper use of equipment, or violation of the Studio’s rules.

12.4. The Service Provider shall not be liable for any injury or damage resulting from a health condition known to the Guest but not disclosed to the Service Provider or the instructor, failure to follow the instructor’s instructions, improper use of equipment, or any other culpable conduct on the part of the Guest, provided that the injury or damage is not attributable to any unlawful or culpable conduct of the Service Provider.

12.5. No provision of these GTC shall be interpreted as excluding or limiting any liability of the Service Provider where such exclusion or limitation is not permitted by applicable law.

13. Personal Belongings

It is the Guest’s responsibility to take appropriate care of any personal belongings brought into the Studio.

The Service Provider shall only be liable for the loss, disappearance or damage of personal belongings left unattended on the Studio premises where such liability arises under applicable law.

Depending on their nature and storage requirements, the Studio will keep lost and found items for a reasonable period of time.

14. Rules of Conduct and Exclusion

14.1. The Guest must behave in a respectful, courteous and cooperative manner towards other Guests, instructors and staff while on the Studio premises.

14.2. In particular, the following are prohibited:

a) endangering the health or physical safety of another person;
b) aggressive, threatening, harassing or offensive behaviour;
c) intentional or negligent damage to equipment;
d) participating in a class while under the influence of alcohol or any substance that may impair the ability to exercise safely;
e) repeated or serious failure to comply with the instructor’s safety instructions.

14.3. In the event of a serious or repeated violation of the rules, the Service Provider reserves the right to exclude the Guest from the relevant class and, where justified, to refuse to provide further services to the Guest.

In such cases, any services already paid for but not yet used shall be settled between the parties in accordance with applicable law and the circumstances of the individual case.

15. Minor Guests

15.1. Guests under the age of 18 may use the Studio’s services subject to the age limits and conditions specified by the Studio.

15.2. In the case of a minor Guest, the Service Provider reserves the right to require the prior written consent of the Guest’s legal representative.

The legal representative must ensure that the minor is familiar with and complies with the provisions of the GTC and the House Rules.

16. Photographs and Video Recordings

The Service Provider shall take and use identifiable photographs or video recordings of the Guest for marketing, advertising or social media purposes only in accordance with applicable laws and, where required, on the basis of the Guest’s separate consent.

Consent to the use of photographs or video recordings for marketing purposes is not a condition for using the Pilates services.

17. Data Processing

The Service Provider processes the Guest’s personal data in accordance with the applicable data protection laws, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), as well as the Service Provider’s separate Privacy Policy.

The Guest may review the detailed terms and conditions of data processing in the Privacy Policy before using the services.

18. Consumer Right of Withdrawal and Termination

18.1. Where the contract between a Guest qualifying as a consumer and the Service Provider is concluded at a distance, in particular online, the Guest shall have the right of withdrawal and, where applicable, the right of termination in the cases and under the conditions prescribed by applicable law.

18.2. If the Guest expressly requests that the Service Provider begin performing the service before the expiry of the statutory withdrawal/termination period, performance of the service shall commence on the basis of the Guest’s express request to that effect.

18.3. If, at the Guest’s express request, the performance of the service begins before the expiry of the withdrawal/termination period, the Guest shall, in accordance with the conditions prescribed by applicable law, be required to pay an amount proportionate to the services performed up to the time the Guest communicates their termination.

18.4. The existence of the Guest’s right of withdrawal or termination and the detailed conditions for exercising such rights shall in all cases be determined in accordance with the applicable laws and regulations.

19. Complaints Handling

19.1. The Guest may submit any complaint relating to the services to the Service Provider in person, by post, or by e-mail.

19.2. The Service Provider shall handle and respond to complaints in accordance with the applicable consumer protection laws and regulations.

19.3. For the purpose of resolving a consumer dispute, the Guest is entitled to refer the matter to a conciliation body.

The Service Provider shall provide the consumer with information on the contact details of the competent conciliation body and the available means of legal redress in accordance with the applicable laws and regulations.

20. Amendment of the General Terms and Conditions

20.1. The Service Provider reserves the right to amend these GTC with effect for the future, in particular in the event of changes in applicable laws, modifications to its services, the introduction of new services, changes to the booking or payment system, or changes in its operating circumstances.

20.2. The amended GTC shall apply to contracts concluded after the amended GTC enter into force.

With respect to services already purchased, the Service Provider shall not retroactively amend the essential terms of the contract to the detriment of the Guest.

21. Final Provisions

21.1. For matters not regulated by these GTC, the provisions of Hungarian law shall apply, in particular Act V of 2013 on the Civil Code, Act CLV of 1997 on Consumer Protection, the legislation governing electronic commerce services and, in the case of consumer contracts concluded at a distance, the provisions of Government Decree 45/2014 (II. 26.).

21.2. The NUA Pilates Studio House Rules and Reformer Equipment Usage Policy contain the detailed rules governing the use of the services and shall apply in conjunction with these GTC.

21.3. Before using the services for the first time, the Guest must complete the Studio’s declaration regarding their health condition, fitness to participate, and acknowledgement of the risks associated with Reformer Pilates.

21.4. If any provision of these GTC is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions of the GTC, unless otherwise required by applicable law.
